Does California's AB 1482 rent control apply to my property?

AB 1482 applies to most California rental properties built before 2004, limiting annual rent increases to 5% + local CPI (max 10%). Exemptions include single-family homes and condos where the owner has provided proper notice, properties built after 2004, and certain other categories. PME evaluates every property we manage to determine applicability.

What is California's implied warranty of habitability?

California Civil Code 1941 requires landlords to maintain rental properties in habitable condition at all times. This includes working plumbing, heating, weatherproofing, freedom from pest infestation, and structural safety. Failure to maintain habitability can give tenants the right to withhold rent, repair-and-deduct, or terminate their lease.

What disclosures are required in a California residential lease?

California requires numerous mandatory disclosures including: Megan’s Law database notice, lead paint disclosure (pre-1978 properties), methamphetamine contamination history, bedbug disclosure, smoking policy, and various others. PME’s lease agreements include all currently required disclosures, updated as regulations change.

What is 'just cause' eviction under AB 1482?

AB 1482 requires ‘just cause’ to terminate a tenancy for covered properties where the tenant has lived for 12+ months. Just cause includes at-fault reasons (non-payment, lease violations) and no-fault reasons (owner move-in, substantial renovation, withdrawal from rental market). No-fault evictions require additional tenant relocation assistance.

How does Fair Housing law affect tenant screening?

Federal and California Fair Housing laws prohibit discrimination based on race, color, national origin, religion, sex, familial status, disability, source of income (California), sexual orientation (California), and other protected characteristics. All screening decisions must be based on objective financial and rental history criteria applied consistently to every applicant.
